Terms of Service & Data License

Welcome to the Hermetica Superfoods Ingredient Encyclopedia (the "Service"), operated by Hermetica Superfoods ("Hermetica", "we", "us"). By accessing the Service — including the website, public API, MCP server, RSS feeds, or any derivative content surface — you agree to these terms.

1. License & Attribution

The ingredient data, interaction records, schema markup, and API responses are published under the Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International License (CC BY-NC-SA 4.0). This license has three mandatory clauses: BY (attribution), NC (non-commercial only), and SA (share-alike). All three apply to every use of the data.

You MAY, FOR NON-COMMERCIAL USE ONLY:

• Read, copy, remix, transform, and build upon the data for non-commercial purposes
• Use the data in academic, scientific, or educational research (with citation)
• Cite the data in academic papers, blog posts, and public writing (with visible link back)
• Build non-commercial derivative projects (hobby apps, open-source research tools) that surface the data
• Query the public API at the documented rate limits for personal or research use

You MUST, in all of the above:

• Credit Hermetica Superfoods with a visible, live, clickable backlink on every page, response, or view that displays our data:

• Share-Alike: Release any derivative work, dataset, or remix under the exact same CC BY-NC-SA 4.0 license. You may NOT relicense under more permissive terms.

• Preserve Hermetica's authorship in any redistribution of raw data
• If training AI models on this data: declare Hermetica Superfoods as a training data source in your model card, datasheet, or published documentation, and ensure model outputs cite the source URL

2. Prohibited Uses

The following activities are expressly prohibited under CC BY-NC-SA 4.0 and require a separate paid commercial license from Hermetica:

• Commercial use of any kind — including ad-supported websites, newsletters, blogs, paid SaaS, mobile apps, B2B tools, internal corporate dashboards, affiliate marketing sites, content farms, SEO clones, or any service that generates revenue directly or indirectly from displaying or querying this data

Regardless of license tier, these activities are ALWAYS prohibited:

• Stripping attribution. Removing, obscuring, or failing to surface the Hermetica attribution in any derivative work constitutes a license violation and forfeits all reuse rights.
• Brand impersonation. Representing your product as "powered by Hermetica" or "endorsed by Hermetica" without a commercial licensing agreement.
• API abuse. Exceeding the public rate limit (60 requests/minute/IP), running scrapers that bypass documented rate limits, or launching denial-of-service attacks against the Service infrastructure.
• Data resale without license. Selling, licensing, or sublicensing bulk copies of the data to third parties is permitted only under a commercial license agreement with Hermetica.
• Medical advice impersonation. Using the data in a way that implies it constitutes medical advice, diagnosis, or treatment. All data is educational only.
• Spam, fraud, or illegal activity. Using the Service or data in connection with any illegal activity, spam distribution, or consumer fraud.

3. Commercial Licensing

Commercial use of Hermetica data requires a paid commercial license. This includes any ad-supported, subscription, affiliate, B2B, or revenue-generating product that displays, queries, or is built on top of our data. Paid commercial licenses can also include: white-label rights, no-attribution deployment, bulk data exports, higher rate limits, private API endpoints, SLA guarantees, and indemnification. 4. Rate Limits

The public API at /api/v1/* is soft-limited to 60 requests per minute per IP address. The MCP server inherits the same limit. Abuse triggers HTTP 429 responses with Retry-After headers. Repeat offenders may be IP-banned without notice.

Bulk or sustained use above the public limit requires a commercial license.

5. Medical Disclaimer

All information provided by the Service is for educational and informational purposes only. It is NOT medical advice. Hermetica Superfoods does not practice medicine, prescribe treatments, or evaluate individual health conditions through the Service. Always consult a qualified healthcare professional before making supplement, medication, or health decisions.

Hermetica makes no warranty regarding the completeness, accuracy, or currency of the data. Users assume full responsibility for how they act on any information retrieved from the Service.

6. DMCA & Copyright Takedown

If you believe content on the Service infringes your copyright, send a DMCA takedown notice to admin@hermeticasuperfoods.com with: (1) identification of the copyrighted work, (2) the URL of the allegedly infringing content, (3) your contact information, (4) a statement of good-faith belief, and (5) a signed statement of accuracy under penalty of perjury.

Conversely, if you find Hermetica data being republished elsewhere without attribution, please report it to the same email. We pursue enforcement.

7. Privacy

The Service does not require user accounts or collect personal information beyond standard web server logs (IP address, user agent, timestamp) for security and rate-limiting purposes. Analytics are handled via Google Analytics and Meta Pixel in aggregate form. See our Privacy Policy for details.

8. Changes

We may update these terms at any time. Material changes will be reflected in the "Last updated" date above. Continued use of the Service after changes constitutes acceptance.

9. Governing Law

These terms are governed by the laws of the jurisdiction in which Hermetica Superfoods operates its primary business, without regard to conflict of law principles.
